According to the Ministry of Human Resources and Emiratization (MOHRE), hiring employees who have broken UAE labor regulations is illegal.
The document also clarifies that an employer cannot be hiring these individuals, not even for probationary purposes, as they will face a fine of Dhs50,000, not exceeding Dhs200,000, for doing so.
The Ministry of Home Affairs and Regulation (MOHRE) further stated that if a domestic worker makes a mistake and breaks the rules, the employer cannot withhold money from his pay. This includes if the worker destroys or misplaces equipment, supplies, tools, or other items on hand or in his care.
Employer deductions in this situation are limited to a quarter of the wage, which would be sufficient to cover the damage as determined by MOHRE and approved by the employee, or approved by MOHRE if the employee declines.
MOHRE also said that the matter would be brought before a judge if neither side accepted the ministry’s decision.
